These Terms and Conditions (“Terms”) govern your access to and use of the Folk Fest Buscador website, platform, services, and related products (collectively, the “Platform”). By creating an account, purchasing a subscription, accessing the Platform, or using any of our services, you agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Platform.

2.About Folk Fest Buscador

Folk Fest Buscador is an online platform that provides information, networking opportunities, festival listings, application support, cultural tour coordination, and related services for folk dance groups, musicians, festival organizers, and cultural institutions worldwide. FFB acts solely as an intermediary platform and does not organize, own, manage, supervise, or guarantee any festival, tour, accommodation, transportation service, visa process, or event listed on the Platform unless expressly stated otherwise.

3.Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use the Platform. If you use the Platform on behalf of an organization, ensemble, festival, company, or institution, you represent that you are authorized to act on its behalf.

4. User Accounts

Users may be required to create an account to access certain features. You agree to:

  • Provide accurate and complete information.
  • Keep login credentials confidential.
  • Maintain updated contact information.
  • Accept responsibility for all activities conducted under your account.

FFB reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

5.Festival Information

Festival descriptions, dates, conditions, participation requirements, financial arrangements, and other information are provided by festival organizers or obtained from publicly available sources. While we make reasonable efforts to maintain accurate information, FFB does not guarantee that all information is complete, current, or error-free. Festival organizers may modify conditions, schedules, participation requirements, or cancel events without notice. Users are responsible for independently verifying all important information before making travel, financial, or participation decisions.

6.Applications and Participation

Submitting an application through the Platform does not guarantee acceptance to any festival.Festival participation decisions are made solely by the respective festival organizers. FFB shall not be responsible for:

  • Rejected applications;
  • Visa refusals;
  • Travel disruptions;
  • Changes to festival programs;
  • Cancellations;
  • Financial losses resulting from participation decisions.
  1. Subscription Services

By purchasing a subscription, you agree to pay the fees displayed at the time of purchase. Unless otherwise specified:

  • Subscriptions are valid for the purchased period.
  • Subscription fees are non-refundable.

Cancelling a subscription does not entitle the user to a refund for any unused portion. Access expires automatically at the end of the subscription period unless renewed. FFB reserves the right to modify subscription plans, pricing, and features at any time.

  • Event performance quality;
  • Any specific outcome.

Users remain solely responsible for their travel arrangements, documentation, insurance, and compliance with local laws.

9.Payments

Any payments made to FFB relate solely to Platform services, subscriptions, consulting, coordination services, or other services expressly identified by FFB. Unless expressly stated in writing, FFB is not responsible for collecting, holding, or distributing funds on behalf of festivals, event organizers, hotels, transportation companies, or third parties.

10.User Content

Users may submit content including profiles, photographs, videos, reviews, applications, messages, and promotional materials. By submitting content, you grant FFB a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content in connection with Platform operations and promotion. Users warrant that they own or have permission to use all submitted content.

11.Intellectual Property

All Platform content, trademarks, logos, designs, databases, software, text, graphics, and materials are owned by Folk Fest Buscador LLC or its licensors. Users may not: Copy; Reproduce; Scrape; Distribute; Sell; Modify; Republish; any Platform content without prior written permission.

12.Prohibited Conduct

Users may not:

  • Provide false information;
  • Misrepresent organizations;
  • Upload unlawful or offensive content;
  • Attempt unauthorized access to Platform systems;
  • Interfere with Platform functionality;

We do not guarantee uninterrupted operation of the Platform.

To the fullest extent permitted by law, Folk Fest Buscador LLC, its directors, employees, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages. Our total liability arising from use of the Platform shall not exceed the amount paid by the user to FFB during the twelve (12) months preceding the claim.

FFB shall not be liable for delays or failures caused by events beyond our reasonable control, including: Natural disasters; Epidemics; Government actions; War; Transportation disruptions; Internet outages; Labor disputes.

We may update these Terms at any time. Updated Terms become effective upon publication on the Platform. Continued use of the Platform constitutes acceptance of revised Terms.

  1. Termination

FFB may suspend or terminate access to the Platform at any time if a user violates these Terms or engages in conduct harmful to the Platform or its users.

  1. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

  1. Dispute Resolution

Before initiating legal proceedings, parties agree to attempt to resolve disputes through good-faith negotiations. If a dispute cannot be resolved amicably, it shall be submitted to binding arbitration or a court of competent jurisdiction located in Delaware, United States.
